Чтобы ее выделить, нужно обратиться в суд
Совместное имущество супругов, один из которых объявлен банкротом, может быть разделено, и до тех пор, пока суд не примет решение о таком разделе, процедура банкротства должна быть приостановлена. Такое разъяснение дал Конституционный суд Российской федерации, рассмотрев дело гражданки Викторовой (фамилия изменена), которой суды других инстанций отказали в выделении ее доли из совместно нажитого имущества в первую очередь.
В Конституционном суде она хотела оспорить конституционность одного из положений закона «О несостоятельности (банкротстве)». В соответствии с ним имущество, принадлежащее супругам на праве общей собственности, включается в конкурсную массу, то есть кредиторы могут претендовать на него так же, как и на личную собственность и средства банкрота.
Это и случилось с Викторовой: когда муж обанкротился, она захотела получить свою долю из совместного имущества — 16,5 миллионов рублей. Однако решением арбитражного суда ее требование было включено лишь в третью очередь реестра требований кредиторов. Это значит, что попытаться что-то получить она сможет только после того, как будут удовлетворены требования кредиторов первых двух очередей.
В Конституционном суде указали, что Семейный кодекс предписывает в случае спора проводить раздел общего имущества и определять доли супругов следует в судебном порядке. То есть, чтобы получить свою часть имущества, женщине нужно обратиться в суд общей юрисдикции. В этом случае она будет выступать не как кредитор, а как супруг, требующий раздела имущества. До того, как суд примет решение о разделе, проводить процедуру банкротства нельзя.
Вместе с тем, оспаривающееся Викторовой положение закона не противоречит Конституции, а потому дело не относится к компетенции Конституционного суда. Поэтому в принятии жалобы к рассмотрению ей отказали.
