Женщина, выносившая малыша, сможет отказаться от процедуры — тогда усыновить его будет нельзя
Процедуру установления родителей, половые клетки которых использовались для оплодотворения суррогатной матери, разработал Минздрав Российской Федерации. Проект соответствующего постановления Правительства России на днях был вынесен на общественное обсуждение.
Как стало известно «МК», установление генетического родства между предполагаемыми биологическими родителями и ребенком предлагается сделать обязательным этапом суррогатного материнства. Процедуру планируется делать не позднее, чем через месяц после рождения ребенка с помощью молекулярно-генетического исследования.
При этом провести ее можно будет по заявлению родителей при условии, что суррогатную мать об этом проинформируют, и она даст согласие на забор биологического материала у ребенка. Иными словами, если суррогатная мать откажется от экспертизы, ребенка усыновить будет нельзя.
Биоматериал ребенка нужно будет брать в учреждении, где он родился, родителей — там, где станут проводить экспертизу. Результаты исследования оформляются заключением, которое подтверждает факт установления родителей в качестве генетической матери и генетического отца или одинокой женщины в качестве генетической матери. Документ оформляется в трех экземплярах: первый выдается родителям, второй как минимум 50 лет хранится в медорганизации, проводившей экспертизу, третий – передается организацию, где родился ребенок.

— Складывается ощущение, что государство берет курс на постепенное запрещение законного использования суррогатного материнства. Документ лишний раз подтвердит право суррогатной матери распоряжаться судьбой ребенка. Это сделает процедуру использования суррогатного материнства еще более неопределенной для родителей, которые самостоятельно завести детей по биологическим причинам не могут.
